How are supervisory decisions adopted in Croatia?

The Council of the Croatian National Bank adopts the following decisions relating to credit institutions:

  • issuance and withdrawal of authorisations of credit institutions with a head office in Croatia and branches of credit institutions with a head office outside Croatia;
  • issuance and withdrawal of authorisations for mergers by acquisition;
  • issuance and withdrawal of acquisitions of qualifying holdings; and
  • issuance and withdrawal of approvals of chairpersons and members of the management bodies of credit institutions.

The Council of the Croatian National Bank is also responsible for establishing credit institutions as insolvent and for deciding whether to submit proposals for the initiation of bankruptcy proceedings or the withdrawal of authorisations.

The CNB Governor regulates (i) the conditions and methods for exercising the supervision and oversight of credit institutions, and (ii) the types of measures taken with respect to credit institutions, as well as the procedure for taking them (including order, time frame, etc.). The Governor also adopts decisions related to the supervision and oversight of these institutions.
