The right to provide payment services on a cross-border basis has been exercised as of the date of accession of the Republic of Croatia to the European Union and is governed by the provisions of the Payment System Act and Electronic Money Act, enabling payment institutions, electronic money institutions and registered account information service providers to provide their services in the territory of the Republic of Croatia (passporting). The use of passports enables payment institutions to provide payment services on a cross-border basis. The use of passports enables electronic money institutions to issue electronic money and/or provide payment services on a cross-border basis. The use of passports enables registered account information service providers to provide account information services on a cross-border basis.
The above institutions may provide their services in the Republic of Croatia by exercising the right of establishment or by exercising the freedom to provide services, when providing services directly.
Where the services are provided through a branch or an agent that provides payment services by exercising the right of establishment, the Croatian National Bank is the competent authority to which the complaints referred to in Article 71 of the Payment System Act and Article 10 of the Electronic Money Act are submitted.
In the case of direct provision of services by exercising the freedom to provide services, the competent authority to which complaints may be submitted is the competent authority of the home member state in which authorisation/registration to provide services was issued to the institution to which the complaint refers. In the case of direct provision of services, complaints may be submitted to the Croatian National Bank, which will notify thereof the competent authority of the home member state.
The Croatian National Bank publicly discloses on its website a list of payment institutions, electronic money institutions and registered account information service providers from other member states for which, in compliance with the procedure prescribed by law, it has received notice of intent to provide services in the Republic of Croatia.
